The Trustees met regularly through the year and approved Grants to Lancing College and Oakham School as shown in the Accounts. A good deal of attention was given to the developing situation at Westway and the Trustees approved substantial support for the EFA's coaching initiative there.
Grants exceeded income in the year and the value of the Fund is now only half of that originally subscribed. There has been discussion of an appeal to raise fresh funds, but it has been decided to postpone that until the EFA Board has received and considered the report from the strategy sub-committee on 'The Way Forward'.
Meanwhile we are very grateful to all subscribers who have continued with their contributions and we encourage all members who can, to make a regular payment to the Trust to enable us to continue the work of preserving court facilities and providing coaching support. Funding by the Charitable Trust has made a difference over the last 10 years: please help us to continue this work and enable our game to flourish in this time of opportunity and competition from other sports and activities.
Members who wish to be reminded of the objects of the Trust, the background to its formation and the responsibilities of the Trustees, are invited to read the following preamble to the Treasurer's Notes to the Accounts for the year ending 2003. Guidance for legacies and bequests has also been added.

TRUST DEED
The Trust was established under a Deed dated 6 July 1993, which was registered with the Charity Commission.
It was formed because it had become clear that a significant amount of money would be needed to preserve and extend the game of Eton Fives. It was also clear that the financial resources then available to Eton Fives were limited, and the chances of the governing body of the game, The Eton Fives Association, raising large amounts of money were small. The Trust was therefore established to raise money and make grants within the scope of its objects for the benefit of Eton Fives.
THE OBJECTS OF THE TRUST
These were summarised by the Charity Commissioners as follows: - "The organisation and provision or assistance in the organisation and provision of facilities which will enable and encourage any persons of either sex up to the age of 18 years, or in the case of persons receiving full-time education up to the age of twenty-five years to play the game of Eton Fives .....".
Specific activities which the Trustees intend to support include: -
ACTIVITIES OF THE YEAR
Background:
In 1995 the Trustees launched an Appeal to a large number of current and former Fives players in order to raise funds to meet the Trust's objectives. This Appeal proved to be successful and a substantial number of donors have contributed funds to the Trust, many by way of regular payments under Gift Aid.
The Current Year:
Income: Regular payments by donors have continued to provide income to the Trust. Additionally income has been earned on the investments of funds held by the Trust.
Expenditure: The Trustees made two Grants during the year, details of which may be found in Note 3 to the Accounts. Further specific commitments totaling £11,500 in support of the Eton Fives Association’s Coaching Activities, and Development Officer for Schools, including Westway, as well as to 3 specific schools in connection with new and replacement courts and court maintenance, were outstanding at 31 December 2003.
REGISTERED CHARITY
The Trust is a Registered Charity, No 1024381.
LEGACIES
Some Members and Friends of the Eton Fives Association have sought advice on the preferred wording for legacies and bequests to the Eton Fives Charitable Trust. Legal advice has been obtained and the clause below is recommended for use where testators wish to leave the Trust a sum of money.
The recommended clause is not intended to cover cases where the Trust is to be left the whole or a share in the residuary estate of the benefactor due to the need to address the issue of payment of tax. In these cases the benefactor should instruct solicitors to prepare the will.
The clause as written makes the legacy/bequest to the Trust free of tax.
THE ETON FIVES CHARITABLE TRUST
Legacy/Bequest Clause for Benefactor's Wills
"I give the sum of .........................pounds (£................) free of tax to the Eton Fives Charitable Trust (Charity No 1024381) of The Court House, Chenies, Nr Rickmansworth, Herts WD3 6EU for the general purposes of the said Charity and I declare that a written acknowledgement signed by either the Treasurer for the time being of the Eton Fives Charitable Trust or the Chairman shall constitute sufficient discharge to my executors and trust.
