
Some Members and Friends of the Eton Fives Association have sought advice on the preferred wording for legacies and bequests to the Eton Fives Charitable Trust. Legal advice has been obtained and the clause below is recommended for use where testators wish to leave the Trust a sum of money.
The recommended clause is not intended to cover cases where the Trust is to be left the whole or a share in the residuary estate of the benefactor due to the need to address the issue of payment of tax. In these cases the benefactor should instruct solicitors to prepare the will.
The clause as written makes the legacy/bequest to the Trust free of tax.
"I give the sum of .........................pounds (£................) free of tax to the Eton Fives Charitable Trust (Charity No 1024381) of The Court House, Chenies, Nr Rickmansworth, Herts WD3 6EU for the general purposes of the said Charity and I declare that a written acknowledgement signed by either the Treasurer for the time being of the Eton Fives Charitable Trust or the Chairman shall constitute sufficient discharge to my executors and trustees."
